The three-judge panel has been appointed and dates set to hear the petition to remove J. Michael Teets and William “JR” Keplinger from the County Commission of Hardy County.
Judge Fred L. Fox III, from Fairmont, Judge Robert B. Stone from Morgantown and Judge Thomas W. Steptoe Jr. of Charles Town will hear arguments on Wednesday, Jan. 22, 2014 and Thursday, Jan. 23, 2014 in Hardy County Circuit Courtroom. Proceedings will begin at 9 a.m.
The petition, filed on Nov. 4, requests the commissioners be removed and asks the court to invalidate the Special Emergency Ambulance Service Fee Ordinance and nullify the purchase of the building formerly owned by the Mathias-Baker Rescue Squad.
The complaint is more than 30 pages long and was accompanied by more than 400 pages of documentation.
As to the removal of the two commissioners, the petition concludes Teets and Keplinger failed to follow the rules requiring public notice of scheduled meetings and an agenda of all regularly scheduled meetings be made available to the public in advance.
The petition states
